The Food and Drug Administration has recognized a growing interest in cannabis-derived products, particularly after the passage of the 2018 Farm Bill. In response to this, the administration announced this week it will host the first public hearing on cannabidiol on May 31, 2019.
Although Congress has legalized hemp-derived CBD, FDA rules still prohibits the non-psychoactive compound from being added to food. The administration, however, is warming up to the idea of allowing it. The May hearing is intended to gather input to guide regulations on CBD in food and drinks. Data and information will be collected about the safety, manufacturing, marketing, labeling and sale of cannabis-derived products.
“It’s critical that we address these unanswered questions about CBD and other cannabis and cannabis-derived products to help inform the FDA’s regulatory oversight of these products – especially as the agency considers whether it could be appropriate to exercise its authority to allow the use of CBD in dietary supplements and other foods” said FDA Commissioner Scott Gottlieb, M.D.
An internal agency will also be formed to explore potential pathways for the legalization of dietary supplements or conventional foods containing CBD. Along with these positive steps, the FDA remains dedicated to warning companies who market their CBD products with unsupported claims.
